Terms and conditions applicable to Inspections

By hiring SERA | Global Logistics, Inspection & Compliance, our clients expressly accept the terms and conditions of our services, available below.
This document aims to indicate the scope of the company SERA Inspection & Compliance in the inspection services that it performs at the request of the contractor (client); as well as number the events for which SERA is not responsible in the event that they occur, as well as when there is no letter of instructions from our clients:
1. In case of Customs Recognition in Mexican Customs (or in any country of destination), where the authority requests the obligatory opening of the container (in service of Prior in Origin), SERA is not responsible for damages, missing, bad accommodation or extra costs that this process generates.
2. In the case of Custom Broker Pre-Inspecion, SERA will not be responsible for the quality inspection of the product. (For this, the hiring of a Quality Control service is recommended, in which it is not responsible either, it only pretends to represent the conditions of the merchandise based on quality standards).
3. SERA is not responsible for non-compliance with OFFICIAL QUALITY STANDARDS for products that require it; such as NYCE, ANCE, NOM or other regulations (RRNA's). Written instructions are requested for them, as well as the sending of certificates so that the SERA team can review and subsequently check with the merchandise in advance of the visit and inspection; Thus, the SERA team will have enough information to make an inspection checklist on the particularities of the review, promoting the security of compliance with regulations by product by country.
4. For the matter of OFFICIAL RULES of commercial information, prior written instruction, the review will proceed according to the corresponding standard and the contractor's instructions, SERA will verify compliance with it.
5. For points 3 and 4 above, SERA is not responsible for non-compliance with these rules in boxes that have not been opened during the Prior inspection or Quality Control, since the review at origin is random based on international standards. Of sampling. For quality control, a Type II sampling level based on the international standard ISO 2859-1, or what is required by the client. For the CBPI a total sampling level Type S3 based on the international standard ISO 2859-1. To do this, SERA informs in the inspection report the number of boxes opened, counted and reviewed (1). If a greater scope of review is required, please request it and it will be quoted separately.
6. No inspection service that the SERA company performs includes product labeling.
7. SERA is not responsible for what the merchandise may contain within it, intentionally hidden or with undetectable defects (Money, Weapons, Drugs, Merchandise or prohibited substances, or for chemical products other than those indicated or agreed between the buyer-seller, SERA only performs a review of the product and the quantities, in an inspection during the boat.
8. SERA is not responsible for the opening of the container by the supplier, freight forwarder or other third party once the inspection is completed (when the inspector has already left) and the SERA security seal has been violated. For this, it is recommended to make your suppliers or logistics agents aware of the inspection service that SERA performs and its consequences in case of opening the container after it has been sealed.
9. SERA is not responsible for the opening of the container by the authority at origin in its export process once the inspection is completed. Compromising what SERA reported in the inspection.
10. SERA is not responsible when the SERA seal and / or the shipping company seal are violated or broken by a third party, where the logistics security circuit has been intervened, compromising what SERA reported as a result of the inspection. (The SERA team recommends that the end customer always check that the seal of the Bill of Lading is identical to that of the seal reported in the inspection).
11. SERA is not responsible for missing merchandise in boxes that have not been opened during the preliminary inspection, since the inspection at origin is random based on international sampling standards. For quality control, a Type II sampling level based on the international standard ISO 2859-1, or what is required by the client. 12. SERA is not responsible for damage to the cargo due to the bad arrangement of the product, poor stowage, lack of lashing. During the inspection processes, SERA can recommend and suggest a correct accommodation / stowage to the supplier or consolidator.
13. All inspection services are quoted by working hours until 6:00 p.m., which means that an inspector is hired in his one-day shift to attend the inspection. The SERA inspector will arrive at the inspection site 2 hours before loading with prior confirmation from the supplier or consolidator, when for reasons beyond the review process or the inspector, after 6:00 p.m. the container has not been loaded, SERA will decide at its discretion how long the inspector will remain in the consolidation factory / warehouse to complete the inspection; In these cases, an extra charge of US $ 100.00 will be generated if the inspection ends between 6:00 p.m. and 11:00 p.m. And USD $ 280.00 if the inspection ends after 23: 00hrs.
14. If the inspection service is canceled or modified one day before the inspection after 12:00 p.m., China time, the cost of USD $ 280 will be incurred. To do this, it is recommended to make your suppliers or logistics agents aware of the importance of the inspection service and to notify the SERA team of any changes in advance.
15. For quality control services. The results that SERA finds in the place and time of the inspection do not relieve the buyer or the seller of their contractual responsibilities, nor do they harm the buyer's right to claim against the seller or supplier for any hidden or undetected defect during the inspection. SERA is responsible only for parts taken randomly as samples and inspected in quality controls.
16. The supplier or logistics agent is obliged to provide the complete information requested by SERA, including packing list and / or loading plan, with a minimum of 48 hours prior to the inspection; as well as confirmation to the SERA team at origin; otherwise, SERA will not be responsible for positioning an inspector on the requested day / time and / or guaranteeing the result of the inspection.
17. Our reports reflect our findings at the time and place of inspection based on selected random samples. The inspections are carried out according to international inspection standards and are carried out in as much detail as possible according to the conditions of the place, cooperation of the shipper / seller, type of merchandise as well as through our knowledge and skills, our responsibility is limited to the reasonable exercise of the inspection. None of our reports exempts shippers / sellers from their contractual obligations, nor does it impair the buyer's right to compensation for any apparent or hidden defects that are not detected during our inspection or that occur afterwards. Inspection reports are not evidence of shipments.
18. The SERA company undertakes to notify the report electronically and ensure that it is received by the client no later than 3 days after the inspection. (There are inspection services that due to their depth may take a few more days but this will be notified to the client with prior notice).
19. SERA undertakes to position an inspector on the date / time agreed and accepted by the supplier / consolidator.
20. SERA will send a letter to the supplier / consolidator prior to each inspection, with the working hours and the extra costs that will be generated to the client in case of not complying with the agreed times, SERA recommends that clients raise awareness among their suppliers to respect container loading and / or inspection times.
21. This format, inspection documents, reports, photographs, images, certificates, supplier information, price list or any material attached or provided by the client is for the exclusive use of SERA (team of designated inspectors or traffic teams) or the entity to which it has been expressly sent, and may contain confidential information or privileged material. SERA ensures that the handling of this information package, considered as extremely confidential, will be used for the sole and specific use of coordinating audits and / or inspections. If you are not the legitimate user or recipient of the same, please report it immediately to the originator of the service. Any review, retransmission, dissemination or any other use of this package of documents, by persons or entities other than those of the legitimate recipient, is expressly prohibited. This agreement is not intended and should not be considered as constitutive of any legal, contractual or other similar relationship.
